bedroom window and carport

A proposed bedroom adddition will enchroach into a proposed carport 6'. A 4x4 window is shown in the sideyard setback and on the carport side. The carport is open on three sides.

Will this window be allowed due to the three open sides??

Using 2001 CBC, exception #3 to Section 302.1 (item #3 in Section 406.1.4 of the 2007 CBC) allows for no separation between R3 occupancy and a carport having no enclosed uses above, provided the carport is entirely open on two or more sides.

So from an occupancy separation point of view, you are ok without separation if that is what you have.

If the bedroom window is the means of emergency escape or rescue, then you need to make sure the window is opening directly into the yard and not into the carport! See Section 310.4 (Section 1026.1 in the 2007 CBC).
