car chargers

wanted to know if anyone has run into an issue when listing a residentail electric car charges and not being able to take the 40% load reduction in the calc. city offical is insisting this is like a commerical application and charger 240v (40amp) must be considered continuous. this is no different than a dryer load but not will not allow me to make the calculation the same. any one run into this problem

Tried the overall load route in sf bay area. Local bo's have a joint opinion that the charger is continuos. Separate meter on load timer qualifies for load diversity. Check with the utility co for their ev rate program, you can save a a bunch on kwhr charges.
