Roof assembly use

We have a project where we have a roof top garden area on the 5th floor of a Type IIIA construction type building. Its a multi family project with the ground floor parking of Type IA construction and the 4 stories above are type IIIA - R2 occupancy.

The garden assembly area is 7487 sf with 495 OL. The comments we have received are as follows: Project si under 2013 CBC.

1. A3 occupancy with type III A construction cannot be more than 3 stories above the grade plane (horizontal assembly) CBC Table 503. The A3 common space is essentially at the 5th floor level - roof.

2. Also in accordance with CBC 510.0 special provision, item % specifies buildings above the horizontal assembly are permitted to have multiple group A uses, each with an occupant load wof less than 300.

The new fire code CFC 2016 903.2.1.6 addresses roof top assemblies.

Also this buildings primary use is R2.

Are there any alternate means and methods that can be applied?

  3. Provide dimensions on the roof plan, defining the common space area verses the roof area. 
the new code of 2016 has a section CFC 903.2.1.6 – which addresses roof top assemblies.
 
Also this building is not an A3 building but primary use is R2.
 
Are there any Alternate means and methods that you are aware of that can be applied?
