Whole Building Ventilation - 2007 CA Energy Code with 2008 Standards

Section 150(o) of the energy code specifies that all dwelling units shall meet the requirements of ANSI/ASHRAE Standard 62.2. This section also states that window operation is not a permissable method of providing the whole building ventilation required in Section 4 of the ANSI/ASHRAE standard.

Section 4.1 of ANSI/ASHRAE Standard 62.2 provides three exceptions for areas that are not required to provide whole-building ventilation. However, one of the three exceptions must be met AND the authority having jurisdiction must determine that "window operation is a locally permissable method of providing ventilation."

Even though the energy code states that window operation is not an acceptable option for providing whole-building ventilation, can a local jurisdiction still use the exception from the ANSI/ASHRAE standard and permit window operation for ventilation?
